Rule 2002 (a)(1) of the Federal Rules of Bankruptcy Procedure requires that at least 21 days notice be given to all creditors of the Section 341 meeting of creditors. This time frame is typically before the plan is due since the plan is not due until 14 days after the case is filed.
When creditors are added to the matrix after BNC has noticed the 341, your office must notice them of the 341 at least 21 days prior to the 341. This leaves a small window of opportunity to add creditors since the 341 is usually scheduled about a month after the case is filed. If your office notices any creditors, please file a Certificate of Service so the Trustee is aware that they received proper notice.
If any creditors are added to the case prior to the 341 but after BNC has noticed the 341 and no Certificate of Service is filed showing the creditors received proper notice, the Trustee will adjourn the 341 and file a Motion to Dismiss the case. Thank you for your cooperation in this matter.
